New controls to ban unauthorised ‘amplified music’ and anti-social behaviour in Burnham-On-Sea’s Manor Gardens are set to be introduced next week.
Sedgemoor District Council is putting in place a new Public Space Protection Order to halt the playing of ‘amplified music’ without permission in the gardens.
The new rules have been requested by Burnham-On-Sea Police following complaints from local residents about noise.
The council will be able to serve Fixed Penalty Notices with fines of up to £100 on those who break the rules and it can also prosecute breaches of the Order.
Council spokeswoman Claire Faun told Burnham-On-Sea.com: “The new Public Space Protection Order means that people in the gardens will have to seek permission to play amplified music.”
She added: “The Order states that people will not ‘play amplified music unless with prior consent by Sedgemoor District Council’. Any person who fails without reasonable excuse to comply with an Authorised Person’s request under this provision may be liable to fixed penalty notice of up to £100 or may be liable to prosecution.”
She added that new Order will have no impact on organised music events in the gardens, such as the annual Jazz In the Park, or other outdoor events which have permission from the council.
“It was a request of the local police team as they attended a number of incidents over the last year. It will go live on Monday but will not take effect until appropriate signage is erected.”
Public events that have permission to be held in the Manor Gardens will not be affected. The Order is targeting unauthorised amplified music.
